re: I spent the last 4 hours or so listening ( rosebowl was right!) - tigerinridgeland
The issue there is whether the information on the NCAA website that contains documents are subject to a public records request. Since FSU was a public institution and used the documents in the website to conduct its business, the documents were public records. Would love to see Ole Miss's respon...

re: I spent the last 4 hours or so listening ( rosebowl was right!) - tigerinridgeland
While it may be likely that Mississippi law is similar to he Florida law, with likely similar results if litigated, the Florida case is not binding in Mississippi. Some information can be hidden, at least in part because the court recognized that redactions of names of students were permitted. The c...

re: I spent the last 4 hours or so listening ( rosebowl was right!) - tigerinridgeland
You may be right on that point. I went back and looked at the rule. I first thought it might limit disclosure to the institution and the witness, but it may be broader than that if Rebel Rags is an "involved individual," which would seem correct. "For all cases to be considered by the Committee o...

Thanks for the clarification. I understand that Merkel does not concern you, and that is fine. I have seen one poster assert rather strongly that Merkel does have a copy. If he does, perhaps it should be of concern as it evidences more disregard for the rules. It could be mere speculation that there...

I understand that they released the response, and that was not improper, and I may have misunderstood, but you referred to a direct quote from Lewis, but he is not identified by name in the response. Is he directly quoted in the response? I know it isn't hard for folks to deduce whose name was ...

re: I spent the last 4 hours or so listening ( rosebowl was right!) - tigerinridgeland
Just curious, but why is someone at Ole Miss providing information to folks who are outside of the university (I assume the NCAA is not leaking documents to alums and lawyers not representing the university)? The NCAA bylaws state: “An institution and any individual subject to the NCAA constitut...

re: Newest Ole Miss tactic from the the leader Yancy Porter - tigerinridgeland
There aren't strong parallels to either Miami or Penn State with Ole Miss. The NCAA investigators haven't used an attorney in a bankruptcy proceeding to try to depose a witness in matters unrelated to the bankruptcy proceedings, and there are no child molestation charges which fall outside the regu...

re: OleMiss Made it Clear All Employees Would Comply w/ Contract - tigerinridgeland
In the meantime the school is spending thousands and thousands of dollars on a suit that could have been avoided, and looked bad while doing it. Even if Ole Miss technically didn't violate the contract, and that is by no means certain, they violated the spirit of the agreement. And that is obvious t...

re: OleMiss Made it Clear All Employees Would Comply w/ Contract - tigerinridgeland
You are trying to construe the contract in a way that really makes it pointless. That is not a favored way to interpret contracts. The language makes it clear what the policy is. It seems absurd to say that the policy was to tell someone not to do something, but you are free to violate the instructi...

re: OleMiss Made it Clear All Employees Would Comply w/ Contract - tigerinridgeland
Ole Miss declined the language proposed by Nutt's lawyers. That is different from explicitly refusal of a nondisparagement clause. They did agree to nondisparagement language in the contract, just not the language that Nutt wanted initially. In contract negotiations, sometimes deliberately ambiguous...

re: OleMiss Made it Clear All Employees Would Comply w/ Contract - tigerinridgeland
Ole Miss has to live with the consequences of the language it chose to use. The university policy is clear that at least control group members were not to make disparaging comments. If control group members made disparaging comments, they violated university policy. It will be a difficult argument t...
