What did you think of the Chinese witness today who did the autopsy?

"I can't remember"... "I have full confidence they did it right"..."I don't remember seeing it"

"opinion" is "not fact"

"I need to explain to the jury why I changed my opinion, but it's still not fact"

You apparently don't understand how high of a burden it is to have such a motion granted. Ignoring the political suicide aspect of the situation, the judge would have been flat wrong in abusing their discretion in such a way.

And for the record, I believe Zimmerman should ultimately be acquitted.

I don't know the standards in Florida for a JOA and I fully understand that it is understandably a high burden but I'm still left wondering, absent the inherent problems directly attributable to elected judges, what evidence has allowed the state to continue forward with a 2nd degree murder charge?

For the sake of full disclosure, I've by no means been following the trial religiously. As such, I would have a difficult time answering that question. However, just from what I've heard, it seems as though the question for the trier of fact is more of a weight of the evidence issue than a true lack of evidence. As such, the judge should allow the jury to serve its role.

That said, I would agree with Ace that reserving judgment on the motion for later might have been appropriate.

I'll also admit that I haven't followed it closely so my position isn't exactly coming from a place of knowledge either. I've simply heard some reports from different sources and it seemed as though the state was devoid of evidence.

As I said, I don't know the standard in Florida and I really don't know shite about criminal stuff, but I doubt the standard you stated is accurate.

I have resorted to listening to MSNBC and HLN to be sure I got the prosecution spin on the case.

I have seen nothing but bull shite from the prosecution = and the spin is all towards mockery of the defense rather than substantiating the prosecution 'evidence.'

Every single statement from a witness so far (excluding defense witnesses just now) has been taken as absolute fact by the spin doctors. In their 're-enactments' they state stuff as fact such as "we know that T tried to get away from him so what Z says just doesn't make sense."

One reason I've been unwilling to follow it is due to the clear bias from the media. What better representation of the media bias than this case displays.
