White House readies order on withdrawing from NAFTA

The Trump administration is considering an executive order on withdrawing the U.S. from NAFTA, according to two White House officials.
A draft order has been submitted for the final stages of review and could be unveiled late this week or early next week, the officials said. The effort, which still could change in the coming days as more officials weigh in, would indicate the administration’s intent to withdraw from the sweeping pact by triggering the timeline set forth in the deal.

This is great news! I took a class in college on globalization. The entire class was centered on NAFTA and it is the root of many evils and we need to get out of it.

Does the President have the power to withdraw from NAFTA via executive order? Shouldn't that be a congress decision?
The 1984 Trade and Tariff Act gave the president authority to negotiate free trade agreements, but congress still had to approve the agreement. Shouldn't that require congress to back out of the agreement? Trump can sign all the papers he wants to, but if he doesn't have the legal power to enact something then it doesn't mean anything.

Article 2205 has been bandied about with the understanding that Trump could withdraw unilaterally. I'm sure there's a judge somewhere that would disagree.

How do they define 'parties'?
If they mean member nations, then the congress who ratified the treaty should have to nullify it.

No idea. Trump used that article in at least one stump speech during the campaign to justify pulling out of NAFTA.
I believe the original agreement was signed by the President and ratified by Congress but not sure if Congress has to be involved to pull out as long as there is sufficient notice made by the party leaving.
I assume this will go to court to decide if Trump can do this on his own. Even if he can, I'm sure there will be some judge who won't like it and will rule against him.

So far we've got Hawaii at 2-1, Washington State at 3-2, and California at 5-3. I'm going to take a semi-longshot and bet on Maine at 7-2.

That's the trouble with using EO's to get around Congress. They are easily blocked/tied up in court.
