I would imagine if it is to conduct official government business than yes. The server was used to avoid FOIA request and using an app like this would be in the same category. I doubt this could be proven though.

Right. That's where she got in trouble.
She claimed the server was used for private, non confidential communications but the fbi found over 2000 emails containing confidential material, iirc.
That does not include over 30k emails that were deleted, wiped, acid washed, bleached or whatever.

If the user agreement for her government-issued device, commonly known as an AUP (Acceptable Use Policy) doesn't allow 3rd party application installation then yes it would be illegal.
