Is this not also a violation of the Seperation Clause? Just the reverse. Congress shall pass no law.
“It is unconstitutional viewpoint discrimination to force the players to remove or alter the cross on their helmets that they chose themselves simply because the cross is religious,” Sasser said.

They acquiesced to avoid a lawsuit. However, it's my opinion that any lawsuit filed would have failed.

Dumb thread title.
Equally dumb, the university pretending not to know better.

keep religion at home and church, not on state purchased helmets at a state university.
what is so damn hard to understand about that.
if you says its okay the state just sponsored Christianity as an authorized religion above the 2000 or so other myths out there.
thats a no no.

Freedom of expression, broseph. If individuals want to openly display their Christianity, they can openly do so wherever they are, whether it's a state school or private school.

Terrible thread title.
But even I think this is all a bit stupid. I mean, yeah, by the very letter of the law, this could be Unconstitutional, but damn. Its so minor, its kind of stupid.

quote:I don't remember that part of the constitution.
keep religion at home and church
quote:Individuals chose to place on helmets, likely purchased by athletic revenue from private citizens
not on state purchased helmets at a state university.
quote:Well, if you understand the Constitution to mean "freedom of religion" ie, anyone can practice their religion anywhere. That's what so hard.
what is so damn hard to understand about that.

You can't tell me you thought this was going to fly at a state institution.

They can, but not as part of an organized school activity that is paid for by the school.
Every fan in the stands could wear a shirt with a cross on it...but the players when they are acting as part of the team on school paid for uniforms cannot.
As soon as they step out of the uniform and are "civilians", as it were, they can wear whatever they want.
Again, this is all retarded anyway.

It's absurd that you think it shouldn't.

How did the state sponsor it?
Is Arkansas State a state run school? Did the school pay for the uniforms? For the stadium? For the field? For the practice facilities? Do they pay for travel? The Coach's salary?

How??:
You put cross on your helmet representing a state institution.
This is a pretty open and shut case.

How about the burkas on campus ?
Let's say school doesn't allow facial coverings, is this OK ?

As long as players weren't forced by the school to put it on their helmets then it's not a religion being promoted by the state.

As a matter of individual expression, I think that is ok.
There's a difference between a player saying something out loud and a school sponsored uniform.
As I said, I don't have a problem with the cross. I think people complaining about it are retards that need to get a life, but technically, they are probably correct.

quote:I'm sure revenue from private citizens paid for a lot of that. Yes, ultimately the school is state-run. Can we not use the same logic to ban all religious articles on all schools? Students can't wear a cross necklace?
