NO, but I could stand right outside the lecture hall on a public university, even with the door closed, and hear what was being said.

Who is talking and what they are saying is not the issue. Where they are saying it and what expectation of privacy is granted is the issue. Unless they are checking IDs at the door, just about anyone could walk in and sit down.

In the final analysis, the syllabus said it up front, he did it anyway. frick him, he shouldn't have taken the stupid class is my opinion on the matter.
Have you ever encountered an individual who flouted the law because he thought it was stupid in your line of work? Was he/she right, or were they still a law-breaker?

Where did be accept the conditions of the syllabus. No one seems to want to answer that.

Yes. However, I also know the law before I try to enforce it. The college's idea of due process is a joke, so their understanding of law is wanting. God Bless them and the plaintiff's lawyer that is about to educate them.

It is very reasonable for a university or professor to have a no recording policy ... They do have copyright on the lecture and make their living off charging students to hear the lecture. Even without a specific "no recording policy", the professor and university would have copyright protections for the content of the lecture.
In fact, a reasonable person would interpret a "no recording" policy to be related to the protection of copyrighted material.
Recording the professor and publishing excerpts to show "news-worthy" leftist indoctrination or rants would not be a violation of copyright (that most certainly falls within Fair Use).
So the student did nothing wrong.
I think the fact that the student has apparently been disciplined more than the professor tells you a lot about the University.
In fact, a reasonable person would interpret a "no recording" policy to be related to the protection of copyrighted material.

The left controls the institutions with a soviet zeal. What they will discover in the next generation is that they are devalueing the worth of their degrees and unwittingly creating a generation of students who will loathe the left. They are also putting big fat targets on their back when the culture war goes hot.
