Sterling loses bid to stop sale of Clippers

An interesting part of the ruling:

No, they can't make the man sell his business because he made an idiotic comment either.

Well, it wasn't an independent business. He was part of the NBA and signed a contract with the NBA.

no but the nba can say he creates a hostile work enviroment for the league and has therefore violated the contract that he signed with the league. Also the trust he set up says that if he becomes in capable of running it Shelly assumes control. 2 neurologist declared him mentally incompetient and Shelly sold the team for $2 BILLION!

In most cases I agree and I think the lifetime ban should be rescinded since he is out of the league.

He signed off on his wife negotiating a sale, which she did.

He then decided to back out on that sale, but he couldn't, she was the decision maker. He tried to get that status back through the courts, which he lost.

She is the one with the power over the team right now, not him.


ETA: with sports leagues, like the NBA, NFL, MLB, etc. you do not have the same powers as with other businesses. You can't just buy or sell to whomever you want. It has to be approved by the league. So the other owners are the ones who are really calling the shots.

Similar to the contract my family signed when we bought in our hunting club (although the Clippers and the NBA is a much larger scale). It states that if 3/4ths of the members believe you are harmful to the club or its image they can kick you out and sell your membership for you. Now you get to keeep the money so that is fair.

That has a contract that Sterling signed in the 80's that gives them permission to terminate his ownership with a 3/4th vote.

It didn't come to that because Sterling is imcompetent and his wife sold the team.

The issue is, and after long threads of back and forth was finally disclosed, that Sterling actually owns jack shite. Owners don't really own anything. They are franchisees and more Akin to operators than owners.

But this case has nothing to do with that, it has to do with how his trust was set up and what power he gave his wife.

Time out guys.

The whole 'mentally incompetent' thing is a CA state law/procedural ruse which will enable Sterling to declare the sale a 'forced sale' (d/t mental incompetence) and thus avoid ridiculous state tax on the sale of the franchise.

So basically I think this sale has been in the works for some time. The 'mental' issue is essentially throwing a bone to Sterling to coax him out.
