Mike and Catherine “Kitty” Burke went through the process to get certified to begin fostering children in 2022, but were reportedly deemed unfit by the Massachusetts Department of Children and Families (DCF) after a series of home visits, according to court documents. The couple filed a lawsuit Tuesday with the Becket Fund for Religious Liberty, arguing that the state was deliberately discriminating against them because of their faith.

You think a it wouldn't be a violation of the Civil Right Act of 64 if a state declined to allow a gay couple to foster kids? The catch all clause in Title II pretty much covers almost any government program. And Title VI covers anything with federal assistance. Doesn't matter what the state says.

This may not be a bad thing.

If Massachusetts can limit those to have traditional beliefs, I'm guessing the more conservative states can decide that homosexuals shouldn't be allowed to foster or adopt.

Sorry. Seemed a bit of a no duh question. What state level law that discriminates against a specific religion is not going to get struck down at the federal level? I mean there could be a law in Idaho that bans heterosexual males from getting a drivers license but common sense tells anyone that the federal law will override a stupid state law like that. The law could stand in the books for the next 50 years but can't be enforced.
