Is the act of just wanting to leave the United States considered treason?

Should the Federal government be able to forcefully detain people who want to leave?

You mean like the Communists did? Shoot people going the other way over the wall?

I've seen some real fricking stupid questions asked, but this takes the cake. Maybe you're trolling though.

Everyone keeps calling the old Southerners traitors because they wanted to leave and saying they should be charged with treason.

All they wanted to do was leave. Which wasn't illegal nor forbade by the Constitution. The war wasn't started because they wanted to overthrow the Federal government. They just wanted out.

Regardless of what one think about this, your example is a terrible attempt at a gotcha.

They weren't leaving. They wanted to declare a piece of the United States as their own without leaving.

Because they wanted to take territory with them. Regardless of your opinion on the civil war, that's a colossal distinction.

No. Do you even understand why most people give up citizenship.

Most of those people live in other countries and don't want to have to pay taxes to 2 different countries. Make a honest, sane tax code and people won't have to renounce citizenship. Citizens living in other countries shouldn't have to pay anything close to full taxes to this country.

That would assume that the United States owned all the states in the 19th Century, which wasn't the case pre-secession.

Also, taking property isn't in the definition of treason.

The definition clearly states that treason involves actively trying to overthrow one's government, which wasn't the case with the Confederates.

I'm going with no

Need more information. I'd think if you're fleeing to avoid some kind of criminal or civil judgment, then yes. If you're just peacing out, then no.

However, the Chief Justice gave the Davis team another interesting argument for dropping the treason charge. Chase asked if a person could be prosecuted for treason against the US if he were not a US citizen. Clearly, no. Then Chase asked if there was a reference to the concept of a US citizen in the Constitution. Again, there was not. A person could only be a citizen of his state. Therefore, by proving that the US had no citizens, Davis couldn’t be tried for treason against the US. It was a clever argument that has never been used again as far as we know.
