Good point that Roe v Wade has politicized SCOTUS unnecessarily

Abortion should be decided by all of us, not just a few of us
CT - jurisprudence seems to focus on autonomy and privacy- does it make a difference?
Miss lawyer - yes constitution applies to and protects privacy, but it’s not how we traditionally conduct due process analysis
CT - you say that this is only Const Right that involves taking life. Why does that matter?
Miss Lawyer - one of the areas where the SCOTUS has submitted question to Democrat process
CT - what legal would you recommend if we don’t overrule? (Searching for standard if they uphold)
Miss - undue burden standard without viability bright line

Breyer - why should we stop following stare decisis on Roe, and if we do, aren’t we succumbing to Public Pressure?
Mississippi- we have gone thru Stare Decisis Factors
Judge interrupts
Mississippi - people did not call for the court to hear this controversy; they wanted it back to them. The Casey stare decisis analysis - Would remove the issue from political process

How do people have the time and bandwidth to sit and listen to these things?

Lawyer accepts the standard of deciding when stare decisis should be overturned is ok, we shouldn’t continue with law bc this has placed a controversial issue in courts

Kagan - right of a woman to choose And control her own body has never been challenged. You want us to reject 15 Justices over 30 yrs have affirmed

Roe is the textbook example for Tenth Amendment jurisdiction.

Kagan Thinks Roe is unoverrulable.
The court has spoken and expectations are entrenched and the decision would look political
Sorry - soltamayor

Soltamayor - MAKING A DETERMINATION ON WHETHER A FETUS FEELS PAIN!
With no evidence
Basically saying that the science that an unborn baby can feel pain is junk science.
My god soltamayor is an idiot and a horror of a human being
