Russia has a legal reason to be there, as they've been invited by the host nation. The U.S. needs a declaration by the UN Security Council in order to be there.
This is pretty cut and dried. U.S.has no reason to be in Syrian airspace, Russia does. If they want to avoid armed conflict, the U.S. will vacate the area. This isn't worth calling a bluff.
