For the lower appointments, the senate had the nuclear option. So I'm not sure what trouble he's talking about.

That's an interesting theory which is supported by the fact that Sandra Day O'Coonor was confirmed with a 99-0 vote. However, if the first woman was confirmed unanimously and the first Italian was confirmed unanimously, why didn't Republcians extend the same courtesy to the Hispanic community when Sonia Sotomayor only recieved a 68-31 confirmation vote?
