Victim less crime, he should walk. For all the " it's dope" crowd , spare me. The same cops that arrested him , prolly went home and got hammered drunk , only to preach about the ills of smoking pot, hypocrites. Leaglize now and no more drug test til the cops and politicians take them also !!!!!!!

So a Louisiana Supreme Court Justice isn't supposed to determine if the law is unconstitutional?

I found it more telling that she was the only one that found this way.

It could happen, the offender here is obviously a dumbass that can't stay out of trouble but 18 frinking years?!?!

But for possessing a little marijuana, the prosecution couldn't trigger the repeate offender statute.

But they found him guilty of "Intent to distribute." that would trigger it, would it not?

I'm pissed as an LA citizen because my hard earned tax dollars are going to pay for a dumbass so sit in jail for 18 years due to him being a dumbass and possessing some marijuana.

The prisons are full of stupid people. Let him out and he has already proven he will go right back to breaking the law....possibly with a weapon in his possession. It's not like he hasn't already done it before and continues to do these type things, right?

quote:

I'd rather punish him by everyone paying taxes in the state getting the chance to back hand him across the face than have him sit for 18years in jail.

That wouldn't be my preference, but I wouldn't mind a shot at backhanding him!

Looks like the majority found that the lower court had followed the law. This doesn't mean they personally agree with it. They might very well find it ridiculous, too.

It appears to me that Bernadette Johnson doesn't know that her role as a justice is not the same as a legislator who passes laws, or a district attorney who charges and prosecutes, or a governor who can pardon or commute a sentence.

Who gives a frick? She's correct, and the more people who stand up and say that these drug laws are bullshite the better. Unless you think that what the US needs are more black people in the prison for non-crimes.

Louisiana is one of the only states that has a 5 year MMS for cultivation of ANY amount of marijuana. I doubt it actually happens for a first time offender, but to have that written into law to begin with is absurd.

If he gets out and sells 18 more joints I think we will be ok.

The war on drugs is an absolute failure. You think those guys are being rehabilitated?

No. But neither are the rapists, pedophiles, armed robbers, etc. the purpose of prison/jail is not rehabilitation, it is punishment. If they are rehabilitated, good! but that is not the purpose.

They lock users up in these private prisons for years and teach them zero skills to use once out.

I thought that was what schools were for? Why did they not learn all those skills in high school? Because they weren't interested?

non-crimes.

I am pretty sure it is a crime. Just because you don't agree with it being a crime does not make it a "non-crime".

How about if he gets out, tries to sell the joints, and it goes bad and somebody gets killed. Will we be ok then?

I will be ok if somebody robs a bank, but that doesn't mean it is good, or right.

Maybe they should stop selling drugs.

So it should be okay to buy it from people to smoke, but not to sell it?

If you want the law changed, talk to the legislature.
