Sidewalk laws, in general, are fricked up. It sits in an easement that you don't own, but if a tree root causes it to buckle, and somebody trips and injures themself, they can sue you. Happened to my neighbor that lives behind me, and he's an attorney. Kid on a trike going down the hill on the sidewalk hit the edge of the walk that had cracked and lifted, fell off and crushed his cheekbone. The homeowner was sued by the kid's irresponsible parents who shouldn't have let the kid go barrel-assed down a hill on a tricycle without a helmet. Because he didn't repair it or contact the city to repair it or block it off until it was repaired, he was held liable because the city ordinance assigns responsibility to homeowners to repair it or report it to be repaired.

Maybe they'll pass an ordinance requiring people to clean the toilets at the courthouse.

the snowstorm in question was an icy mess for a few hours in south Boston so there was something like 6 inches of snow on top of a layer of ice

and this came a couple days after a ~12 inch snowstorm which was mostly powder and easy to clean up

If the argument is the city's pedestrians need the sidewalks then wouldn't it be a city issue? Why fine her. If it's her property, what are pedestrians doing on it?

Given the option for higher property taxes for snow removal and this ordinance, the residents will choose this ordinance every time

i'm just asking since you seem to know a little about the situation, what about ice or rain on the sidewalks making them hazardous also? Is this just a snow ordinance or an all inclusive safety ordinance?

And in this instance I would agree with you 100%... definite need of "user beware" law/ responsibility in those instances.

But clearing the snow off sidewalks in populated areas being the homeowner's responsibility is very practical if you have spent anytime where regular seasonal snow occurs.

I happened to be north of DC when they had 30" of snow last year... everyone was out clearing snow off of sidewalks. A homeowner who had a snow plow would gladly plow snow from neighbors who were hand shoveling when he was done with his own sidewalk.

I spent some time the last few year between Boston and DC... For the most part the people are pretty awesome but also scratch my head why their politics are so screwed up.

It's just snow and ice.

Although you can be fined for obstructing the sidewalk in other ways... like leaving equipment or parking there. I've been hit with the parking one because I wasn't all the way in my friend's driveway.

Neighbors helping neighbors - that's nice. But I still say it's unconstitutional to make people shovel snow off public property.

Okay, I get that. Outside of this woman's age and inability to chip out ice on her own, I'm one of those people who travel for business a lot. Many times I'm inserted into military operations where I have no communication with the outside world. It sorta sucks that I would be held liable for an act of nature while I was not in a position to deal with it. Gotta be many people like me out there

We have to do it here in Duluth, too. I've not seen a ticket for it, but they are militant about not parking in your own driveway such that you block the sidewalk.

It would really suck if they were aggressive with me. I live in a corner, and on one side of the house, the sidewalk is right against the street. When the the plow comes by, I can have 2-3 feet of dirt and ice encrusted crap all the way down that sidewalk.

I keep the other one pretty clear. Not that hard when it's fresh snow. Blower mows right through it.

What I don't get is why there is not a bigger deal made about her brother picking up the tab. It's his insurance company that raised the fine from residential $50 to commercial $200.

Yeah, I was a bit confused about that too, but then I saw the pictures and it was pretty obvious. The little old lady with a snowshovel is a better photo op to prompt social media response like this thread.
