Instant divorce legislation

It's state of La. and heard it on local radio today.

The bill would waive the 6 month rule on divorces becoming final in the cases of abuse. The advocate for the bill said it would allow abused spouse to be safer. No new time limit was given. Let's call it 'divorce in 5 days'.

My questions...

1. What prevents an abused spouse from leaving the premises immediately and staying away until the divorce is final?

2. If couples want to divorce and remarry other people, what is to prevent them from fabricating grounds of abuse?

3. When was the 6 month standard established and why?

So, which legislator is looking for a fast and speedy divorce?

And, what constitutes abuse?

"He said I could afford to lose a few pounds. I want a divorce, IMMEDIATELY!"

Sounds like a good way to encourage false abuse allegations to ensure a speedy divorce.

re: Instant divorce legislation
where are all the christian republicans raising hell about this and wanting a constitutional amendment banning divorce????

Doesn't it say in the bible that divorce is a sin?

I don't think so. But I do know that divorce is easy in the Koran. All you have to say to one of your 4 wives is "I divorce you" 3 times.

Perjury

Not sure when and don't feel like looking it up but it was established because LA has a strong presumption in favor of marriage, i.e. to prevent divorces and facilitate reconciliation.

Or, if you have a machete handy, just chop off her head.

Perjury

If perjury was criminally enforced in domestic cases, you would have to turn the entire state of Alaska into one big prison to hold all of the violators.

I can tell you didn't read the bible

quote:

He said to them, “For your hardness of heart Moses allowed you to divorce your wives, but from the beginning it was not so. 9 And I say to you: whoever divorces his wife, except for unchastity, and marries another, commits adultery; and he who marries a divorced woman, commits adultery.”

so even though Jesus says there are no reasons for divorce, other than unchastity. The Catholic Church uses that same reason to back up the idea of annulments.

Divorce is fine for Christians but there must be a reason for it.

re: Instant divorce legislation
Fabricating abuse (or alcoholism or philandery) for means of a divorce was quite common until the last couple of decades. "Irreconcilable differences" was not an option

Weird how it's coming full circle

You don't really understand domestic abuse at all, do you?

The same thing that "prevents" them from murdering their spouse, dissolving their body in acid, and dumping the resulting slush into the river - there's a law against it.

Dunno. Used to be a year.

Yes, I do. My dogs maul me every day when I sit down in a chair and try to put on my shoes. My wife just laughs. That's abuse.

The same thing that "prevents" then from murdering their spouse, dissolving their body in acid, and dumping the resulting slush into the river - there's a law against it.

And the law for claiming 'abuse' is bright line...just like the law against dissolved in acid? Really?

re: Instant divorce legislation

Just looked up the bill.

It requires proof.

LINK

See line 10 and item (4) under it. Although no conviction is required, it does require "proof" - I'm guessing it requires a preponderance of the evidence rather than beyond a reasonable doubt - which is certainly fair as it is a civil proceeding.

BTW, all yall are welcome.

Some couples reconcile and pull the filed divorce papers symbolizing the triumph of hope over experience. (raises hand)
