"The President . . . shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment."
A reprieve is the commutation or lessening of a sentence already imposed; it does not affect the legal guilt of a person. A pardon, however, completely wipes out the legal effects of a conviction. A pardon can be issued from the time an offense is committed, and can even be issued after the full sentence has been served. It cannot, however, be granted before an offense has been committed, which would give the President the power to waive the laws.
I've been thinking of this as well as Hillary. I interpret this to mean pardons do not even require a "charge", much less a conviction. Am I right, that he would have the power to exercise pardons to both Hillary and illegals?

There was a lengthy article in The USA Today today re Presidential pardons, and bottom line, there is a time line involved, starting with the DOJ initiating the process. The main point of the article was that there was no real time for Obama to pardon anyone before he leaves office that is not already being "processed", a specific reference to Hillary for the most part.

Even if he pardoned them for their crimes up to January 19th 2017, aren't they immediately committing a crime by being here on January 20th?

Technically, the President can only pardon for past actions. After granting a pardon, illegal immigrants would immediately be violating the law by having an unlawfully presence in the U.S.

So just to clarify for me, they would be pardoned for being here illegally, but would immediately be in violation of law because they are still here? If true, the pardon in the case of an illegal alien allows no time for them to leave?

How would that even work without knowing who illegals are? You can't just pardon an unnamed group of people. That would lead to future illegals retroactively claiming they were pardoned because how would you prove they weren't in the country illegally at the time of the pardon?
