Flag Burning & Justices

Fellow PB posters,
This flag burning nonsense is alarming to me in the fact that the President elect voiced an indefensible opinion about it. It is also alarming that it seems some erroneously think it is illegal or should be. If you consider yourself a supporter of liberty and freedom and support a law against flag burning you should reexamine your core truths. A flag doesn't make anyone an American. Love and belief in individual liberty and freedom does. This is not a liberal vs conservative, republican vs democrat issue. It is an American issue. Both sides would happily limit freedom beyond burning cloth: LINK
Everyone appears interested in Scalia's replacement and this is a perfect issue to explore that and what a justice should be. Some of you know how much I love Scalia quotes so...
A Bill of Rights that means what the majority wants it to mean is worthless.
If you're going to be a good and faithful judge, you have to resign yourself to the fact that you're not always going to like the conclusions you reach. If you like them all the time, you're probably doing something wrong.
What is a moderate interpretation of the text? Halfway between what it really means and what you'd like it to mean?
As long as judges tinker with the Constitution to 'do what the people want,' instead of what the document actually commands, politicians who pick and confirm new federal judges will naturally want only those who agree with them politically.
In the eyes of government we are just one race here. It is American.

I'm glad Trump said what he said. But, I don't support a law to make it illegal and don't really think it will be an issue.

I knew when he tweeted it that CNN would have headlines all day about Trump being a fascist. However, I do not think it is a ridiculous thing to discuss, albeit not on Twitter. Old Glory is a venerated object, and burning one is certainly on the fringes of free speech. Burning the Flag of the United States is guaranteed to get a hostile response from bystanders, and doing so is deeply offensive to the majority of Americans.
Overall, I think the First Amendment is in place to allow Americans to be idiots, and thus flag burning should be discouraged but allowed.

I don't care what other people do with their stuff. The whole point of freedom is to be able to do things the masses find reprehensible as long as they don't hurt anyone.

The title of this story is incorrect. It should read: Trump Baits Liberals into Burning Flags Everywhere, Giving Them Terrible Optics And Causing Them to Lose Yet More Ground in the Culture Wars.

What Trump did was something I call 'Poking the Monkey'.
a. He says burning the flag should be illegal.
b. This prompts Democrats to go out and burn tons of flags in front of cameras.

Trump's position is stupid but short of it becoming a Constitutional Amendment, it would immediately be thrown out by the courts. It's never happening.
As for his Supreme Court justice candidates, IF he sticks with the Heritage/Federalist Society list, we're fine.
