Attorneys will bring up the age of the NBA, the history of punishments, and the by laws. Then ask him why his punishment was harsher than all of the history. What was done by Sterling that was worse than Kobe. Why did he not act against an Owner who posted PUBLICLY pictures making fun of a guy with a disease?
There is noway Silver gets out of questions like that. He, in the least, will have to explain his punishments VS past history and vs the Shaq issue where nothing was even done.
All in all, this will paint the NBA as going after an old man because others wanted his team. It will be painted as strictly money is all that matters. That the NBA isn't really concerned about racial issues, about LGBT...

Friday: Sterling reportedly accepts $2 billion. Apologists- Sterling is a genius. He doubled his worth. He got 3-4 times the value. This was all planned. He played the NBA.
Friday afternoon: reportedly his wife had him declared mentally incompetent and she the lone trustee over the trust which owns the team. She negotiated and she accepted $2 billion. Apologists- this is a stunt for Sterling to get the money tax free. He's the big winner in all this.
Today- Sterling doesn't want to sell the team for $2 billion and is suing the NBA for $1 billion. Apologists- We told you he'd sue the league and he'll win. The mental capacity thing was a stunt to sell the team tax free and win another billion for the NBA!

Here's a man who has no control over his trust because of his mental incapacity, cannot stop the trustee from selling his team and is suing the NBA for making him sell his team which he has no legal capacity to sell. And even if he did and they did, he's coming up with at least twice the value. The value of which he has no control. He's no longer a trustee of the $2 billion. And he's claiming losses.
I seriously don't know who is fricked in the head more, Sterling or his apologists.

You should volunteer for jury duty sometime. I think you'll be disappointed what the rules of evidence actually allows. A 2L straight out of evidence is going to be able to successfully object against most of what your wanting to hear on the grounds of irrelevance and speculation.
