Do we have the right to a clean environment?

Maybe Bernie could push for an amendment to the Constitution

"constitutional amendment that would have recognized in the Bill of Rights that “[e]very person has the inalienable right to a decent environment.” H.R. J. Res. 1321, 90th Cong., 2d Sess. (1968). The proposal failed, as did later attempts to recognize such a right. H.R. J. Res. 1205, 91st Cong., 2d Sess. (1970)."

There are no rights "to" something, only "from" being acted upon. I consider myself a tree hugger to a large extent, but something as vague as "a clean environment" can open up an entire can of worms and legislation to suit the definition of whoever is in charge.

Pollution is a negative externality that somewhat negates the pure private property concept.

I do think water is a must. Nobody wants to live like the Aiel.

You certainly do, in my opinion. Unfortunately, environmental litigation for things like air and water quality are extremely difficult to bring about in today's legal environment. There were a few court cases in the latter 19th century that basically ruled that economic productivity took primacy over individual property rights.

To the extent that an unclean environment threatens our capacity to live, there's an argument to be made

If you own property, you have the right to demand it be free of nuisances caused by neighbors. If our tort system worked as it was designed, we wouldn't need a federal environmental law regime, because it could be handled via class actions for nuisance.

Nuisance is used to enjoin a neighbor from doing things which prevent you from enjoying your property like burning tons of stuff, producing smoke, blasting loud noises all night long, or allowing toxic runoff to pollute your land.

Perhaps we have a duty to make the environment as clean as possible but no "inalienable right".
