B) The President has to actively claim executive privilege for it to apply
Is it appropriate that Comey shared these notes and allowed to be leaked? No. But it isn't illegal.

The FBI never opened an investigation into leaks. Because Comey was the damn leaker
The FBI never leaked that Lynch was obstructing justice. Comey leaked that Trump was, but didn't back that up in testimony
