Now a group of deposit box renters who have had their assets taken but not been charged have filed a class action lawsuit against the government.

The renters argue the government violated their Fourth Amendment protection from unreasonable search and seizure and their Fifth Amendment protection from having private property taken without compensation.

That case is literally insane.

ONE guy was SUSPECTED of committing crimes, so they went in and took everything out of over 100 people's boxes and just said, "frick it, we're keeping all this shite."

I can't imagine any scenario under which any court could possibly allow this to occur.

Yep. It hasn't been a free country in a few decades.

It's crazy how they can just take your money/property and force you to spend thousands in legal fees in hopes to get it back.

All pigs LOVE civil asset forfeiture, it's universal. From the fat arse small town deputy to the highest echelons of federal law enforcement.

I wonder how much has been seized over the years in assets and cash through CAF in the US. Has to be in the hundreds of billions of dollars.

Any fines collected need to be paid to the State General Fund, not any local municipality

I believe the correct mantra would be...

The more we allow our government agencies to trample on our rights, the more our rights will be trampled

It's 2023. You can't imagine a court would allow this? I can. I think they are screwed.

The case will be decided by the 9th Circuit Court of Appeals after a lower court sided with the FBI last year.

Near the bottom of the linked article. A court already DID side with the FBI. Freaking egregious.

i'm not entirely against civil asset forfeiture in some scenarios, along with some eminent domain cases, but they should be so rare that they go before the supreme court every single time.

Hardworking blue collar NOLA guy caught up in a cash seizure at airport - he was traveling to buy a tow truck to start a new business.

Feds took $28k in cash and it took years and nonprofit legal assistance to get it back. Looks less and less like the America of our founders every day.

Yep. As long as you continue to give your lunch money to the bully, he'll keep taking it.

Forfeiture will continue to be abused. It needs greater restraint or go away completely.
