Why would I want to give away my hard earned money for free for someone to start a for-profit business for their own private profit interest - when there are plenty of people looking to start a for-profit business that will take my money and return it to me with interest (at least so long as the business doesn't fail).
If I want to invest in business I'll take my money and loan it out to a business (or more practically give it to someone else who will do that for me).
If I want to be charitable towards people who are trying to start business - I would go to one of those websites where you can make an interest free loan. That way if they succeed - the money comes back to me and I can loan it out to another businessman.
Kickstart just seems ripe for abuse like mentioned in the OP. There is no real accountability - is there?

The point of kickstarter is to give money for ideas.
It is NOT a donation, and this guy is in the wrong morally and by the spirit of the TOS of Kickstarter.
You aren't investing in a company as much as you are prebuying their product.

I've backed probably 15 different projects on kickstarter and only one didn't get sent to me.
Guy took the money and ran. But he's now pretty much ostracized in the community.
