Any chance Trump deports European DACA recipients with no criminal charges

THey were not brought here legally. Obama basically ignored established immigration laws to implement DACA. These people took a risk and came up short. They cut in line.

If brought here legally they would not be DACA.

If they overstayed their Visa then they broke the law. Kick them out

It is also a fact that one can overstay their visa and that is a crime. like, indisputable, true, not false, demonstrable.

Besides, why single out Europeans? Immigrants are immigrants, no matter their creed, religion, race, or ethnicity.

there are also work permits and student visas that allow young people to stay after their visa is expired while they await their green cards.

I see. And I can see it being personal if it's family or friends who are in that situation. It sucks that people have to commit a crime in search of a better life. But rules are rules. You can't have it both ways. Can't make examptions for Vlad, Zhang Wei, François, Jose, or Raj. Either you're for all leaving or all staying (minus criminals and government handout recipients of course).

If they are on a visa or work permit - they are not DACA. By definition DACA is for individuals who are undocumented (hence deferred action).

If you are DACA you either entered illegally or illegally overstayed a visa or permit or tourist clause. There are zero people in the US that are DACA that did not break a law. Zero.

let's just say their legal counsel advised them to forego the work permit and register under DACA in order to get a green card quicker.

Well that sucks. The first DACA recipient has been detained (due to possible gang membership). I know his case is different than most DACA applicants, but it still makes you wonder what exactly is going to happen moving forward. Depending on the mood Trump is in, DACA could go away with the stroke of a pen and mass deportations could ensue. And because every DACA applicant handed over their information, the government knows where they live and could deport them as soon as their deferment ends.

If I was your European friends, I wouldn't panic, but I would be concerned and hope Trump doesn't have one of his "Mexico" days.

So legal counsel was for them to go from documented to illegal so they can attempt a different status?

What state bar do we need to inform on this practice?
