Local governments already have this power.

For example, Georgia passed legislation effectively banning KKK members from wearing hoods in public 65 years ago (yes, the Klan was actually pretty unpopular in the South in 1951, years before desegregation). It was upheld as constitutional by the SCOGA in 1990.

The GA law says "A person is guilty of a misdemeanor when he wears a mask, hood, or device by which any portion of the face is so hidden, concealed, or covered as to conceal the identity of the wearer and is upon any public way or public property". As noted here last month, a GA legislator proposed inserting "or she" right after the word "he", expanding the clearly gender-discriminatory law to include women as well, essentially making it a misdemeanor to wear a burka.

Naturally, the bill was withdrawn after a firestorm of criticism from the usual suspects.

I agree with you, however. The entire law should be overturned, as it is clearly targeting Klansmen (I assume Klanswomen - or Klanspeople identifying as female - are exempt).

This is Germany we're talking about here. They have no first amendment. After WWII they outlawed the Nazi party and were throwing people in jail years later for being sympathizers. They also jail people for denying the holocaust (still to this day people are imprisoned for what amounts to a thought crime).

At the end of the day this is nothing but a transparent move by Merkel to appease the growing anti-Muslim sentiment over there. It's nothing but a move to win re-election. Just a few years ago Merkel was out in public wearing burkas and encouraging other Germans to do the same. Hypocrisy and flip-flopping at its finest.

This isn't the US, it's Germany, their freedoms of speech and religion don't extend nearly as far as ours do. Try denying the Holocaust on television there, see how fast that lands you in trouble with their government.


Merkel pushing this is the problem because just a couple of months ago she would have balked at the mere hinting of such.

It needs to happen in Germany and in other European countries where their laws already allow such a law. Much like Libya and Turkey were bottlenecks (until recently) for people fleeing the violence in the Middle East, Europe and the Atlantic are our bottlenecks keeping them from coming here in the overwhelming numbers Europe is seeing.

Let them deal with it in ways our laws will not allow so we don't get put into such a situation where one of our most treasured freedoms becomes a noose used to kill us.
