Today, the Ninth Circuit affirmed a decision by a lower federal court in San Francisco that upheld a school district’s ban on the wearing of American flag shirts on a California high school campus in 2010 during Cinco de Mayo (May 5th)—a Mexican holiday.
AFLC Co-Founder and Senior Counsel Robert Muise, who argued the case before the Ninth Circuit, commented:
quote:
On May 5, 2010, school officials from Live Oak High School in the Morgan Hill Unified School District, California, prevented five students from wearing American flag t-shirts because the officials did not want to offend “Mexican” students on “their day.” That day, some students at the school were celebrating the Mexican holiday known as Cinco de Mayo. School officials approved the Cinco de Mayo celebration, which was co-sponsored by M.E.Ch.A, a school-sanctioned student group.

Moreover, despite banning the American flag, school officials permitted the Mexican students participating in the Cinco de Mayo celebration to wear clothing that had the colors of the Mexican flag.

Can the American flag shirts be worn on other days?
(Still don't like the ruling, but nothing surprises me with anti-American Progs)

From the decision:

The panel affirmed the district court’s summary judgment
in a civil rights suit brought by high school students who
were asked to remove clothing bearing images of the
American flag after school officials learned of threats of race related
violence during a school-sanctioned celebration of
Cinco de Mayo.
The panel held that school officials did not violate the
students’ rights to freedom of expression, due process, or
equal protection. The panel held given the history of prior
events at the school, including an altercation on campus, it
was reasonable for school officials to proceed as though the
threat of a potentially violent disturbance was real. The
panel held that school officials anticipated violence or
substantial disruption of or material interference with school
activities, and their response was tailored to the
circumstances.

a) was the ruling correct or incorrect according to the law?
b) American flag tshirts are disrespectful to the flag and break the Flag Code.
The people melting over this would rather feel like victims than know stuff.

Oh okay so their freedoms were restricted because the mexicans are violent about American flags. Let's not worry about the violent offenders but take away freedom because we have to submit to their violent nature. Sounds like freedom, huh?
This great, fostering an environment that rules in favor of the violence against any representation of the American flag.

Their reasoning doesn't help you.

No big deal, you cant wear Mexican flag shirts in Mexican high schools on July 4th. Not...
In reality this was probably to avoid tension if a few students wore the American flag just because it was may 5th, but still this is the United States. Even Mexican students should have pride in the American flag if they are freely choosing to live here

Maybe because mexicans aren't celebrating July 4th and they never have.

Well, seems like we are seeing the violent proggies take up this idea and put it up on a national scale, aren't we?

Yep. This ruling shows violence wins over freedom.

When will the discrimination law suit be filed?

And they don't have to. Just like US students don't have to celebrate Cinco De Mayo. Is it a federal holiday?
I mean I'm all for a reason to go have some drinks and respect Mexican independence, but should our freedoms here be restricted on another nations holiday?
