I mean I think RICO is a bullshite law that should be unconstitutional, but as of today, March 17, 2024, it's not.

And Trump is charged with violating RICO with a slew of other felonies. 3 attorneys have already taken pleas, 2 of which were for felony charges. All have agreed to cooperate against Trump. I mean one was the literal architect of the "fake elector" scheme. This is how a successful RICO case is typically prosecuted.

The allegations against Trump have nothing to do with free speech.

I already said RICO should be deemed illegal, but until we start culling our police state, things like exist (and can't be "lawfare")

Those charges against Trump have everything to do with things that he said and nothing to do with illegal actions he committed.

The fake elector schemes are not Trump's words. The actions are being prosecuted. Filing false statements are also actions. Aren't they also accused of tampering with election equipment? That's not speech, either.

Whether you disagree with his lawyers strategy, doesn’t make it a crime. He was using a strategy that his lawyers proposed, and the remedy isn’t a RICO prosecution, it’s losing in court… Al Gore lost at the Supreme Court on his challenge in Florida, Trump got Laches and no standing. It just seems like the whole system was rigged against him that year…

But his organization didn't engage in fraud to build the case argued there.

And I say fraud because multiple attorneys in the GA case have admitted to fraud, so it doesn't require an "alleged" anymore.

The fraudulent acts are the issue. They always have been. That's where legal strategy moves into potential illegality (potential because this has not been determined yet).

Now, can Trump rely on a defense that he's dumb and ignorant? Yes, and it may win. I don't think any of us believe he's going to do that at trial.
