Given the question that was asked and that he appears to be the only white person in the train car, that's a fair question. But since no racial epithets or language was used there's no way there could be a hate crime charge.

I don't understand why this is important. If a person is weaker, it's understandable if/why they don't fight back. Whether the victim chooses to defend his/herself doesn't necessarily excuse the inactions of the bystanders.

I also wonder why the dude just sat there and took it. He was neither small nor elderly. Of the two choices, fight or flight, he did neither.
He was suckerpunched and trapped in a corner on a train by 3 young males. Any sane person would cover up and take it.
However, since this is the internet, he should have stood up whipped out his 45 and capped them thugs.

For it to be a hate crime, yelling "frick whitey" wouldn't even be enough. You would need to put, in writing, that you intend to assault someone for being white, have it notarized, run it in the paper as an announcement for two straight weeks, and then have your grandmother testify, under oath, that she saw you commit the crime.
ETA: obviously I'm joking, and my joke was also intended if the situation were reversed

There needs to be some evidence that the crime was racially motivated. The fact that they were of different races is insufficient.

Easy's response about not defending himself reminds me when the law REQUIRED a woman to physically fight back and basically take a beating before the law would consider you raped.
