Collateral damage is a military term.
"Actual damages" is the only correct term in this post.

Jesus, you're all riled up, aren't you? Looking for a fight, huh? He said the dog came off leash, not that it was running around loose. There are too many facts we don't know yet. Given the seemingly minor injuries, suing his neighbor could be a giant waste of time. But you're right. You know everything. And if you state it with enough EMPHASIS, you may just convince someone.

If this really was on public property and especially if it were unprovoked you should contact animal control immediately.
What if you don't report it, the owners continue to be lax with their control over it, and some small kid gets attacked?
Assuming these people are keeping the dog up to date on its legally required rabies vaccine then the worse case scenario is likely just a 10 day quarantine. This is occasionally done in home too - animal control often decides.

not looking for a fight, but I feel strongly about this issue. as a responsible dog owner myself it pisses me off that trash out there will let their wild unpredictible and dangerous dogs run loose.
as another poster said, next time it may be a kid..I pray it isn't yours.

a poster was badly hurt and in pain and you want to argue semantics? I'm done. just want all to be safe and the dog to be put down. then the homeowners tried appropriately.

Arguing semantics? This isn't semantics. This is you being an idiot.
If the dog needs to be put down because the facts dictate that, then so be it. If the homeowners were irresponsible and need to have criminal and civil charges brought against them, then so be it. Those are issues that we cannot, without more, intelligently and responsibly advise the OP to do. The only thing we can say is to have the OP talk with the homeowners about the incident to see what steps can be taken.

I don't know that suing the owner is appropriate here but animal control should know about this incident no matter what the guy does with a lawyer. It's important that this dog have a documented history of biting a human should it continue to do it. There's a reason that in my work I am legally obligated to report bites when I know they've occurred.
It probably would not be put down unless it is way out of date on rabies vaccination or there is no history of rabies vaccination. Then they're in some hot water and it all comes down to what state and occasionally what county they live in. I've lived in areas where it's a little slap on the wrist (paw?) and I've lived in areas where the state veterinarian was tough as nails regarding unvaccinated dogs and human bites.
