Why can't passengers have an open container in the car?

Push aside OC laws in general because I think they're dumb, but what good reason is there to not allow a passenger to drink if driver is not?

Otherwise, the driver could pass his OC over to whoever is sitting in the car.

I think there is a state or two that still allows open containers. Mississippi maybe?

No, but its a matter of public policy.

Another reason: a road is public, and drinking on it would be drinking in public which is also outlawed.

I hate to agree with you, about anything, but this I'll concede on. It makes no sense to me either.

I've had 2 instances where the passengers were drinking and the driver wasn't when we were pulled over, both times in LA . One time I was driving and the other I was a drinking passenger. Neither time the cop made a big deal about it. Once, we were actually commended for having a DD.

Passengers in Missouri are free to drink.

Seriously?

Because cops would get tired of hearing a driver slur the following words "No (hic) that's my buddy's beer! I wasn't drinking from it or anything! Honest, I swear to God!"

and once they fail the sobriety test, they go to jail.

passing a beer to your buddy doesn't negate the 10 you had earlier that night.

I mean, there is no actual answer to this question. It is a matter of public policy for the general public's safety. Sure, many drivers don't drink while their passengers are, but it is a preventative measure for those who actually do.
