You'll feel pretty bad if you hit them, I bet. Especially if they total your car.

Runners should have to obey all traffic laws and pass an inspection.

They should be pulled over and given a tix.

I run with a headlamp, but it doesn't matter much, you assholes in cars try to run me over anyway.

I would feel bad. BUT, we have some that dress in all black and walk right next to the road! At night! Fricking gives me high blood pressure when I drive within a foot of them! Just think their IQ is not very high.

To all you drivers who speed through my neighborhood as a cut-through to avoid the light on the boulevard,

And FWIW when I walk the dogs when it's dark (every day this time of year), I put a reflectorized backpack on them.

The first thing I do when I buy a new bike is remove all reflectors and anything that adds unnecessary weight.

A man and a woman routinely walk/jog along a state highway near my home while wearing camouflage jackets. The roadway has a very narrow shoulder and long portions of it are shaded by the wooded tracts along the route. They are out there during daylight hours but I'm often right on top of them before I can see them. Idiots!

You should graze them with your mirror to send a message. Like a high and tight fastball to back him off the plate.

You'll feel really bad after you hit them and they or their estate sues you for negligence and wins a metric frickton in damages.

Serious question- if a runner/biker is out at dark in dark clothing on the roadway with no light or reflectors, someone hits them- is th driver at fault?

I don't think reflectors are really the issue here, I've never seen anyone take reflectors off of a bike. People are too busy texting to see other cars much less a runner/biker.

It would probably depend on if you were texting or talking on the phone at the time.

It depends, brah.

There is such a thing as contributory negligence and it seems to be the answer you're searching for.
