Question about the nuclear option

I thought it made it to where you only needed a majority vote not 60. Keystone did not pass cause it did not get 60. What am I missing. TIA.

The nuclear option just changed the senate rule stating that you need 60 votes to end debate or filibuster. It didn't change how many votes you actually need to pass any legislation or appointments.

For federal appointments (judges), not legislation.

It doesn't take 60 for a bill to pass. It takes 60 to beat the filibuster.

This part is true at least for now. Reid said it wasn't off the table to change it for legislation too. The nuclear option itself refers to using a simple majority instead of 2/3 to change senate rules. They used it this time to for appointments, but it could just as easily be done for debate on legislation.

Except SCOTUS appointments.


It would be bad for the Republicans to entirely end cloture rule now. The advantage a party gains from that will be fleeting - essentially limited to one Congress. So they'd want to maximize the gains they can achieve by ending cloture - and with a Democrat in the White House - those gains could be minimal.

Nothing say the GOP could not change this rule to apply to anything, and then ram through a bunch of shite. However, they won't do that, and may well change the appointments rule back.

Yeah they could change it however they want for whatever McConnell wants to bring to a vote. They won't though
