Pregnancy is the result of rape, and the situations you describe above are ways of holding men accountable for rape. It doesn't have to be non-consensual to be rape, people get raped willingly all the time. Rape can occur without physical contact and sometimes without the raper even knowing it's occurring. Chauvinist men who hate women have far too narrow a definition of rape and use that unfair definition to discredit heroes like the woman in the OP.

I don't suppose this argument would have done the falsely accused any good if he tried to use it as a defense.

No defense really helps the falsely accused. He just has to hope the woman's story falls apart.

So the guy's life is destroyed, he probably spent a while in jail, and she only gets 32 days? Seems reasonable

32 days?

Wtf?

Dude could have gotten like 3200 days if convicted.

Should be 5 years.

IWNHI, who would even believe her claim in the first place?

She could walk around naked in Angola Prison and no one would approach her...

Hopefully the guy sues her and takes her for all she's worth and then some. Welcome to garnished wages and large judgment you won't ever pay, bitch.

Double edged sword in my opinion. I agree that there should be stiff penalties for maliciously lying about rape and kidnapping, but I also get that it would scare off real victims even more.

So what should the recourse be had this happened 20 years ago and he spent all that time in prison based on a fabrication?

It should be double time for her.
