Updated:Drunk driving wreck and leaving the scene

A kid that used to go to school with my daughter was drunk driving and wrecked his car tonight. Lost control and ran in the ditch. His car is probably totaled.
Instead of sticking around and getting a DWI, he left the car there.

Will they still be able to arrest him or how does that work?

He should just chug booze and go back drunk so that he can say he got drunk after the fact

Well yeah. They'll arrest him for hit and run. And probably DUI.

He's fine, like I said they can't prove shite.
Tow the totaled car and chalk it up, big deal ....

If there were no injuries or property damage, there will be no hit and run charges. He probably made a good move. Insurance rate will go up, but better than a DWI. Keep him away from your daughter.

Because who else would have been driving it? They'll get him. You already know about it so I'm sure a bunch of others do to.

Could've been anybody that knows how to run a car into a ditch!
They have no way of proving he was the driver or if you was driving.

I don't understand what's so hard to understand about that.

He don't have to answer any questions, all he has to do is keep his mouth shut. It's not rocket surgery ....

You seem quick to say he's fricked.

He could easily say he let someone else drive if he says anything at all. Hard to charge him with no actual evidence he was driving.

All he has to say is he drank after leaving. DUI wouldn't stick
