IRS Sniffs Around Food Perks For Silicon Valley Tech Workers

San Francisco tax attorney Steve Moskowitz says the IRS has been sniffing around the food perks for years.
“That has been around forever,” Moskowitz said. “The first time I was asked that question was in the early 70s.”
While the IRS is looking at it as a “taxable fringe benefit” — meaning the government needs to be paid for 30 percent of the fair market value — Moskowitz says it’s all in how tech companies package it.
“If the employer says “As part of your compensation, I’m going to give you a free meal,’ then you can get taxed and that’s been tried,” Moskowitz said. “However, if the employer under the Internal Revenue Code 119 says ‘I’m giving you this for my convenience and my benefit,’ then it’s not taxable — plain and simple.”
While lunch and snacks may be out of reach, other tech perks like gyms, yoga and child care might be fair game.
“Then we’re talking about the fair market value of what you’ve been given,” Moskowitz said. “Again, the big dividing line is — is this compensation, then it’s taxable, or is it for the convenience of the employer.”

I say no. Employers like Google are reacting to studies that suggest that healthier, happier employees are more productive employees.
John Doe employee is less likely to take more leave if they aren't always going out for lengthy lunch (lunch hour traffic, restaurant seating delays etc) or trying to leave early to get to the gym or pick up junior. That usually means more productivity for the employer.

Yeah. It sounds like it can be spun in a way that if it benefits the company it isn't taxable.
Food can be spun how you did.
Gyms can be positioned as helping the company healthcare costs by promoting healthy life styles.
Not sure how they could with childcare. Maybe the productivity angle again since they'd be on site.

I work in tech, and I would say no to the food but the shite like free massages and daycare, then yes they should be taxed

Exactly. You can eat in the cafeteria for free or go out for lunch. The only reason for them to feed you is to keep you on site for the full day.
Trouble is you have rules being made by people who never had a real job and have no clue about the real world.

The food at google is insane. My buddy has an ice cream parlor, and I volunteered to help him scoop ice cream for an event at Google over here in Mountain View. I was stunned at not only the variety, but the quality of the food.
The Google employees were so far in their little world that it was awkward communicating with some of them.
