An in depth look at why the IRS/DOJ really admitted the lost emails exist

I did some analysis and research and found out that judge Sullivan was so angry at the way the IRS and their DOJ appointed lawyers answered his first inquiry that he took extraordinary steps when he issued the following order on Aug. 14 in response to the IRS's declarations to his inquiry.

JUDGES ORDER

In light of...... the Declarations filed by the IRS, the IRS is hereby ORDERED to file a sworn Declaration, by an official with the authority to speak under oath for the Agency, by no later than AUGUST 22, 2014 (last Friday) in this Declaration, the IRS must (1) provide information about its efforts, if any, to recover missing Lois Lerner emails from ALTERNATE SOURCES ( i.e., Blackberry, iPhone, iPad); (2) provide additional information explaining the IRS's policy of tracking inventory through use of bar code property tags, including whether component parts, such as hard drives, receive a bar code tag when serviced.


He had a couple of more orders in there, but they have been rendered meaningless with this new revealation that the emails are backed up.

A Judicial Watch ( JW ) spokesman stated that JW has filled hundreds of FOIA lawsuits and had never seen this type of court action in his 16 years with JW.

Judge Sullivan authorized JW to submit a request for limited discovery on Sept. 10.


Judge Sullivan took the additional steps to appoint Magistrate Judge John M. Facciola to manage and assist in discussions between JW and the IRS about how to obtain the missing records. Magistrate Facciola is an EXPERT IN E-DISCOVERY.


So to wrap up, Judge Sullivan on August 14, angry that IRS officials were playing games, required them to go under oath, placed a Magistrate who was an EXPERT IN E-DISCOVERY to assist both sides in discussions about the missing emails/hard drive and also ordered a respone by August 22, 2014.


And on August 22, 2014 DOJ lawyers appointed to represent the IRS, admit that the emails have never been lost.

So, once a judge demanded officials go under oath and appointed a magistrate to assist in discussions the IRS/DOJ comes clean !!!!

This judge is going to really be pissed off come September 10.

Issa probably has enough for perjury charges against the IRS head who stated the emails were lost for good.

A no BS judge brought the facts out, props to Judge Sullivan.

Yep, I've been reading more abt the JW case and judge Sullivan than trying to follow Issas parade.

So basically you can lie if you can get away with it, but when pressed, you'll come clean?

How is that not a federal crime for these people who are caught lying under oath?

But Rex, Tuba, DS, VB all said that this was a phony scandal, nothing to see here, Lerner was being witch hunt, are you calling them liars?

That's the thing about some of these congressional hearings where government officials "testify"... they're not really under oath. They're just there to provide info "as best they can". That's what this judge was trying to do... make them go under oath, hence the change in tune.

It was the same deal with Hillary and her "testimony" on Benghazi.

Yep, the judge has much more power than congress in this instance. Congress knew they were limited, and that is why they have been pushing for a special prosecutor...

It's a travesty that the people that WRITE the laws in this country can't make people testify before congressional committees under oath.

There is the little matter that IRS personnel did not produce the emails pursuant to a subpoena from Congress, and senior IRS personnel testified that the emails were permanently lost. The contradictions between what was told to the Court and Congress need to be resolved.

And then there is the matter of the content of the missing emails. Until the content has been reviewed and analyzed how can anyone know whether they implicate IRS, or other executive branch, employees of wrongdoing. Have you forgot that Lois Lerner refused to cooperate with Congress in determining how and why conservative organizations were subjected to unusual scrutiny when applying for tax exempt status?

Only 100 emails prior to 2011 hard drive crash have been produced to Congress compared to 16k after that time...

Seems like I've heard fo people being prosecuted for lying to congress and lying to the FBI..........

Wonder when the DOJ will press charges here?
