OT Lawyers: Legal question regarding a phone and a dog!

My 11 year old niece was at a friend's house with many other kids. While they were in the pool, the kids placed their valuables on a 3' table which was near the pool. The homeowner's dog jumped on the table and grabbed some stuff, including my niece's new iPhone (which was in a case called life box?). The phone and case are ruined. These items cost nearly $600 together. The dog/home owner says he/she is not paying. Does my sis-in-law have a chance of being reimbursed?

Edit: Just be clear, I do not care one way or the other. I see fault on both sides.

Suing will cost more than the phone. shite happens.

Forget about it unless you know longer want them as friends.

You can't be serious. So much wrong here. The fault lies with your sister for buying an 11 year old a $600 phone setup that she obviously wasn't ready for.

tell them that you will call animal control and have the dangerous animal put down if they dont cover the phone cost.

Should the homeowner offer to pay? It would be the "right" thing to do. BUT, this was an accident amongst friends and better left as an accident.

I wouldnt put valuables on a 3 foot high anything near a pool where children and dogs are running/playing/splashing near.

Exactly. If the mom didn't teach the daughter the responsibility of protecting something of worth, then the mom shouldn't be pissed at anyone but herself.

Some of you amaze me...no reading comprehension. My in-laws are not neighbors with these people. The adults involved are not friends. My niece and the home owner's daughter are friends. Friendship is not a factor/concern in this matter.

ETA: This is the second thread where someone has said their phone was in a life case and it is ruined..What is the point of such and expensive case if it can't get wet

I'm not going to read that whole thing, but if these people are such good friends then it's not worth throwing that friendship away over some 5 year old's phone. Especially if you're not even related to said 5 year-old.

No need to be an a-hole. You never once mentioned that they weren't friends.

The fact still remains that your SIL is stupid for buying a fricking 11 year old a $600 iPhone setup. The "acquaintance" isn't responsible for shite. It is pretty much 100% your family's fault.

The case is waterproof to 6 feet. It's not dog-jaws/teeth proof. I used mine to take underwater pictures snorkeling in TCI for 4 hours yesterday. Not bad for $90.

Also: who buys a phone for an 11 y/o and doesn't get Apple Care +? They would cover this no questions.

If bought with a credit card it may be covered for 90 days under a buyer protection plan. This is free with American Express and may be offered with Visa and MC as well. Absent that, check your homeowner's policy for coverage.
