However, while Allen, from Philadelphia, was covered to carry a gun in Pennsylvania, she made the mistake of crossing into New Jersey with the weapon and now she's facing a mandatory minimum of three-years in jail.

Allen said that she didn't know her permit didn't apply to New Jersey so when she was stopped for a minor traffic offense she told the police about her gun and her permit to carry. In this case, being honest may have cost her.

“The judge tried to tell me that telling the truth messed me up, my life up and the cop said the same thing. Me opening my mouth and speaking out he said I’m one out of ten people that spoke up and was honest and that got me in trouble,” she said.

Allen was charged with unlawful possession of a weapon and possession of hallow-point bullets which were in the gun. Under New Jersey gun laws, the illegal possession of a gun is a second-degree felony which holds a minimum sentence of three-years in prison.

Allen’s Attorney Evan Nappen feels that the judge doesn't have a lot of discretion in this particular case.

“We’re talking about a law-abiding, licensed person who did nothing wrong. She is now facing three-years minimum mandatory, where the judge has no discretion, in state’s prison,” he said.

Allen has no criminal record and only owned the gun for a week. So far the Atlantic County Prosecutor has denied her entry into a diversionary program that would allow her to avoid jail time.

And no one any where in this process told her that her permit was only valid in the state of issue? Or to check local gun laws before traveling?

The NJ law is a bad law, but it is the law.

She should know the law of every location she carries a firearm into. This is simply part of being a responsible firearms owner.

Lack of knowledge leads the general public to cast their most important vote, the all mighty dollar, recklessly. She obviously was planning on contributing to the NJ economy when she clearly disagrees with their polices.

Many states have reciprocity with CCL's. NJ does not.

I feel for her but at same time you have to know the law. She should have been taught that in a ccw class. The level of ignorance pertaining to gun laws is a prime reason why people accept gun control. New Jersey is a bastion of gun control along with much of the northeast. Know the laws or have a really great attorney

I know exactly where my permit is valid.

And Yankees are just dumb.

Pathetic.

But laws are laws. Although she only had it for a short time, she should have been more aware. First thing that I do when if I get pulled over is throw mine on the dashboard, in clear view. Then I politely tell the officer that I have a gun and I CC. Only happened once, and it was a seatbelt checkpoint. Cops here love bitches that CC.

I know I was. I have a map that says which states my permit carry over into, which haven't replied to the requests, and which are a solid no.

I understand the law is the law. And I understand that minimum sentence requirements are often worse than useless.

However, doesn't the DA has a choice as to whether or not to prosecute the case or at least what the person will be charged with and prosecuted for?

Why not just plead the whole thing down to something next to nothing since it appears this was an honest mistake made by a law abiding person?

They prefer to have their schools shot up, I guess. They don't realize what one CC holder could possibly do in a situation like that.

I guarantee you that she knew. But I guess some people are going to try to pass this off as an accidental border crossing.

Something about the bridges and hour long drive into the next county (Atlantic County is on the other side of the state) tells me she would have a tough time passing this off as a mistake. So I guess she is pleading ignorance.

This woman makes a mistake and she could get sent to prison for 3 years?

All the "the law is the law" responses make me sad.

There is absolutely 0 reasons why this woman should be sent to prison. There is no justification for that.

The laws in this country are simply idiotic. More and more continually get added. It is already pretty much guaranteed that you will break at least one law unknowingly each day.

That is a problem.

That is what is ridiculous about the law. Since she is a legal gun owner and not a felon, it shouldn't warrant jail time. At most just a fine.

That's absurd. She told the truth. You would think that would count for something.

3 years is absurd. Fine her, not lock her up for 3 years.

It is illegal possession of a firearm. But yes, the prosecutor should plea it down.
