Denver and Boulder issuing gay marriage licenses

There is a constitutional amendment that prohibits it, but Utah's same law was struck down but the ruling was stayed for potential appeal to SCOTUS.
The governor and AG say they won't fight but worry the clerks are creating a legal mess.
This can be our daily gay marriage thread if you like, or you can ignore it.
Personally I support gay marriage but I do worry about the cities ignoring a constitutional amendment, even if it really no longer applies.

I am a little confused. I know in some legal situations the losing side, if it appeals, can stay open/conduct business till the appeal is brought before the court.
Is this a similar situation. Meaning were they issuing licenses then the amendment passed to stop it.... then, because it is under appeal they can continue till the appeal?
If so that happens all the time and I see no reason to stop that.
I am against same sex marriage fwiw (against federal involvement in marriage as a whole)

I think that is the rub, its status is a little vague at the moment. Once the SCOTUS declines to hear this, and I think they will decline, it means the ban is over-turned. But if it does hear it, and then overturns the ruling, what happens to those who were issued licenses?
It gets even more complicated b.c a state appeals court overturned the amendment last week.

well this would be CO's involvement in gay marriage not really the feds.

I'm curious as to how it plays out given that it is an election year for Colorado.
Gov. Hickenlooper and Sen. Udall are already running as far away from Obama as they can and Hickenlooper is shooting himself in the foot over the gun law he signed.
This obviously energizes the LBGT community but, given their relative size, I'm more curious as to whether the backlash against it ends up being a net negative for the Dems.

I think the people that are against this were already voting for beaupreuz for gov. Personally I think Hick wins this no problem in the fall. I don't like him but Beaupreuz already lost once to ritter. And CO has a lot more younger voters now due to the weed thing. I could be wrong.
I loathe Corey Gardner, and might actually vote for Udall in the fall. But I think Udall is going to lose.
I think the state house/senate is where the action is going to be, and where I expect the republicans to do very well.
