Your liberal friends need to research what "militia" meant in the 18th century.

If Burger was right, why doesn't it say "the right of the militia"?

Also ask your fruity friends this: If the founders thought gun ownership should be tied to militias, why didn't they pass gun laws?

I was not aware that a lobby's opinion of an Amendment to the Constitution was one that mattered.

what matters is 5 of 9 justices.

Gun "rights" hang by a thread.

Who cares what a retired / dead judge thinks?

The idea that a portion of the bill of rights was written to defend the state is ludicrous IMO.

I could literally declare myself a militia and that would be it. My friends and family could declare themselves a militia.

Using 18th century definitions, the amendment can be written as this: "Because an efficient armed populace is necessary for the security of a free state, the right of the people to keep and bear arms shall not be infringed".

The "gun lobby" doesn't even make that last argument.

the problem the second amendment is that it is in a couple hundred year old document. I think it should still apply, but they didn't write it for modern america. I think the justice is correct about it's original purpose but that isn't a good argument against gun ownership.

edit: here is the text from the 2nd amendment the justice does have a decent point.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

On a federal level possibly, but the states will not fall into line. What are the Feds going to do withhold funds that are delivered to them by the states? Let the pissing match begin!

don't act like this is a settled issue. The USSC held that belief until like just now.

So a conservative Supreme Court justice was wrong. Liberals don't have a complete monopoly on ignorance.

this issue will never be settled the language isn't specific enough there are ways you can read it that support both sides.

example:
There is no longer a need for militia therefore people don't need weapons.

Example from the other side:
The first part of the amendment only mentions the need for a this amendment, the second part of the amendment states that everyone should have a right to bear and keep arms. Just because the need is lost doesn't mean the amendment no longer applies.
