Johnston arrived in Las Vegas with the woman he was dating on the Thursday before the Super Bowl. He drank in the limousine from the Las Vegas airport to the Grand, drank more during dinner with friends, and then says he blacked out.

"It's certainly an extraordinary case. This is not a story that I've ever heard before, where someone was blackout intoxicated where they couldn't read their cards, and yet a casino continued to serve them drinks and issue them more markers," Lyttle said. "It's a very heavy-handed and unusual approach that we haven't seen in this town in a long time."

This. I know of at least 3 instances where I have blacked out drunk and lost a few hundred bucks. I couldn't imagine losing a half million, but then again that's chump change on the OT.

That's his way of saying "back in my day we would've taken this guy to a back room and he would be begging to pay us the money."

Don't you guys get it ? There is no such thing as personal responsibility anymore.

They should make this dumbass pay an extra half million for wasting the courts time.

Maybe Mike Anderson could try this if the football helmet lawsuit doesn't work out.

He may have been blacked out drunk, but the woman he was dating wasn't

Getting blackout drunk and blowing all of the cash you have on you in the casino is one thing. Even using your ATM card and getting cash that the casino can't keep track of is one thing.

Once the casino starts issuing you markers, or loaning you money that they keep track of, they enter a much higher level of responsibility that the casino has to legally demonstrate.

If there really is video and eyewitness evidence of him being visibly intoxicated and/or incapacitated, he'll have a case for the amount of the markers.

This. It's true the patron should have been more responsible but it's bad business to do that. It's also illegal in Vegas for a casino to continue to serve someone visibly intoxicated.

Then again, there's lowlife all around this story. The guy was 52 and getting blackout drunk in a casino? A downtown casino at that? Definitely NF.

Good job, feminists.

This narrative that you're not responsible for your actions if you're drunk started with them.

Drunk driving? Your fault. Held accountable.
Drunk sex? Not your fault at all...it's the mans fault, even if he was also drunk.

Psh.

I mean if bars are getting sued successfully for drunk driving and held legally responsible for those consequences, id say this case (if as drunk as he sounds) is open and shut because getting that much in markers you'd have to see how drunk he was.

I could see the guy winning this.
