Under President Obama’s stricter drone policy, the CIA wouldn’t be able to launch the attack because the man is a U.S. citizen. The Defense Department is the only U.S. agency that can sign off on such drone strikes.
One source said the military is unsure whether the man is dangerous enough to kill.
According to multiple officials, the suspected terrorist lives in a country that won’t allow U.S. military action on its soil.
The AP agreed not to identify the name of the country where the man is believed to be because officials said doing so could interfere with counterterrorism operations.
The report comes just days after the Washington Post reported the administration has sharply reduced drone strikes in Pakistan.

Seems like an easy answer to me. Build a case, and just go arrest him. No need to drone in this case.

An American who goes to war against the United States shouldn't expect to be treated any differently than the people he takes arms up with

If this is true and they know if for a fact and they can't get in to arrest him or if arresting him jeopardizes the life of Americans, then drone him.

That is odd, I haven't seen that in the Constitution, nor do I see it applied to serial killers.

Just had to know that you and some of your ilk would take this kind of stance based upon the person making the decision as he can do no wrong. He gets the same treatment one could expect from the Catholic church and the Pope in matters of faith.
