Federal Judge in NY Rules NSA Phone Surveillance Is Legal

quote:

A federal judge in New York has ruled that a massive federal phone-tracking program is legal.

U.S. District Judge William Pauley issued the decision Friday. He says the program "represents the government's counter-punch" to eliminate al-Qaida's terror network by connecting fragmented and fleeting communications.

In ruling, the judge noted the Sept. 11 terrorist attacks and how the phone data-collection system could have helped investigators connect the dots before the attacks occurred.

He says the government learned from its mistake and "adapted to confront a new enemy: a terror network capable of orchestrating attacks across the world." He said the data-collection program was part of the adjustment.

He dismissed a lawsuit brought by the American Civil Liberties Union. The ACLU did not immediately respond to a message for comment.

The article is very limited in describing the scope of reasoning behind the decision but from what it does say, the decision wasn't based on legality as much as the ends justifies the means school of thought.

People are dumb. It really is simple:

They who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety. - B Franklin

That's the way I read it. Who would think that a federal judge, who probably has little knowledge of technical capabilities, would botch this?

There's your problem.

9/11 is the gift that keeps on giving for statists.

Last week's opinion from Judge Leon ignored legal precedent...he was basically creating new law on his own whim

Would like to read this new opinion

Anything that justifies the tyranny of the Obama Administration seems to be cool with some here.....

Wait.
Wait.
Wait.

A judge reverses course on bad legal precedent which is in contradiction to actual written law, and you call that creating new law?

Comical but expected.

bad legal precedent

Smith is still the law of the land

which is in contradiction to actual written law

Could you explain this?

This seems to be the crux of it:

quote:

Judge Pauley: "Because Smith controls, the NSA's bulk telephony metadata collection program does not violate the Fourth Amendment."

9-11 has become the biggest excuse for the Gov't to take our freedoms. Newsflash: It was 12 years ago..people aren't worried about Al Qaida anymore. They are, however, worried about their privacy and Gov't intrusion into their lives.

These recent Federal Judge rulings are just sickening. They are nothing but appointees by the Obama Administration to further his agenda and make it look "Constitutional". This is the type of negative effect using the Nuclear option has.

It's one thing to blatantly prove that freedoms and liberties are just an illusion in this country.....
It's another to insult my intelligence.

The overreach of the NSA has been greatly expanded on Obama's watch. We're 5 years into the Obama Error; time to stop blaming everything on Bush.

Obtw, does this mean that Obama can now ignore the 46 recommendations that the panel HE COMMISSIONED came up with?

Must be related to this guy:

Just another war-mongering, statist-elite republican goon that is all about protecting the military industrial complex and who would pull every constitutional protection away from the citizens in a heart-beat if it meant protecting the established power he and his ilk have accumulated.

Yes, it's time to forget that every President since Woodrow Wilson has furthered the agenda from the previous one, and concentrate on our hatred of Obama while relishing in the knowledge that once we get someone in there with a "R" in front of his name, things will be all better.
