Once again, the NCAA does not own or operate shopncaasports.com. Jay Bilas doesn't understand this and apparently nobody else does either.

They may not own or operate it, but they sure as hell are involved with it and making money from it. Hence the reason the registered NCAA trademark is allowed to be used in conjunction with the site, and there is a link to the NCAA homepage at the top Also, the only way that they can say that they are the "official" NCAA sports shop is with NCAA approval... How do they get that approval? More than likely by paying the NCAA substantial royalties.
Sorry if I'm wrong in my assessment. If I am, please explain to me the certain legalities of this as I am not a lawyer.

Yes, the people that own the site have paid the NCAA to be able to sell official products. The NCAA cannot control how that site markets the jerseys it sells. If they want they can refund the licensing fees paid by the site and not allow them to sell any more licensed products, but they haven't done that to date.

At the very least, they're allowing a third party to profit using the image and likeness of players. I believe the NCAA itself has a phrase it likes to use in these instances: lack of institutional control.

No, you've pretty much got it right. The site can use the logo because they've paid to be able to do that. Kinda like franchising a business. You pay the royalties to McDonalds, and in turn you can use the arches logo. But you own that McDonalds, not the MCdonalds corporation.

Either way they're selling the jerseys. Gettin paid to let someone else do it does not have any impact on the discussion.

I'm just curious if anybody else can confirm this. It's been a couple years since I've been on campus. Maybe my alzheimer's is setting in early, but I don't remember this.
