| Update: On kid killed because he was in the "wrong driveway" (Posted on 2/2/13 at 9:12 pm)
LINK I originally suspected there was more to the story than a gun crazed nut gone mad
quote:
The victim's brother, David E. Diaz Valencia, said they were trying to find the home of a friend of Diaz's girlfriend when they pulled into Sailors' driveway by mistake.
quote:
Earlier in the evening, about 8 p.m., the girlfriend's father said he spoke with his daughter, who stated that she was on her way home. He did not know that the friends were headed out elsewhere
quote:
police were dispatched to the scene for "trouble unknown" just after 10 p.m.
The Atlanta Ice forum closes at midnight, yet they were 30 minutes away still looking for "a friend" to go skating, after 10 pm. And after the girl told her dad she was on her way home at 8 pm. Skating til midnight, an hour round trip to take the friend back home, means the teenager wasnt getting home until 1 am. But was supposed to be on her way home at 8. Why werent they just texting the girl that they were in her driveway waiting, rather than trying to open the old mans door?
quote:
Another witness told police that a male subject was overheard yelling "why was someone trying to get inside their house."
quote:
a complainant told emergency dispatchers that a car was in her yard, that people were shouting, and that two gun shots were heard.
Seems like they were caught breaking into his house, and then tried to flee once he caught them. He probably told them to stop, and even fired a warning shot.

Doesn't matter, there are very few circumstances where it is legally justified to shoot someone that is fleeing.

Was he shot in the back? I haven't heard about this until this thread. Perhaps he tried to force his way in and the homeowner met him at the door?

So that story has a few paragraphs on Diazs family life no paragraphs on Sailors family life. Why is that?

Sticking to the "guns kill" meme that the media has latched on to?

I haven't re-read the article but it seemed as if the article was stating that the guy was shot in the head as he was driving away.

He was shot in the head as he was driving away, according to those with him. But the man fired a warning shot, held the others at bay until police arrived. It also looks like his wife was the one who called 911 because the caller said the car "was in her yard." I'm guessing they were trying to break in, he confronted them. Told them to stop, while his wife called police. He fired a warning shot and tried to prevent them from leaving. The driver continued driving (maybe right at him) and the old man shot him The old man was a former missionary. Its VERY hard to believe that he didnt accept that they were at the wrong house and just came out firing. Why the warning shot? Why not shoot more of them?

if he continued driving right at him, he would have been shot in the face, not in the head. When I read your story I immediately thought of Homer Simpsons dad. GET OFF MY LAWN!!!

The face is a part of the head according to last look at a Grays' anatomy book.
