| League's offer to Vilma may reveal conflict of interest (Posted on 12/10/12 at 8:52 am)

The story from ESPN has since been updated to reflect the terms offered to Saints linebacker Jonathan Vilma. According to Ed Werder of ESPN, the league offered to let Tagliabue determine Vilma’s suspension, in exchange for Vilma dropping his defamation lawsuit against Commissioner Roger Goodell. The offer was promptly rejected, as it should have been. Tagliabue already will be determining Vilma’s suspension even without the dismissal of his defamation lawsuit. So what’s the point of even making the offer? Arguably, the league’s offer implicitly concedes that Tagliabue currently has a conflict of interest. If Tagliabue exonerates Vilma, the defamation lawsuit would get stronger. Which would mean that a member of the law firm that represents the NFL will have made a decision that creates potential civil liability for the man who runs the NFL. Which would result in liability for the NFL, which surely is picking up the tag for any judgment entered against Goodell. By clearing away the defamation lawsuit, Tagliabue would be free to conclude that Goodell got it wrong, without the unpleasant reality of putting Goodell and the league in the cross hairs of a significant monetary judgment.

I mean, this is exactly what I thought about when I first heard about the settlement offer. This whole thing just smells, as we all know, and our season is ruined almost regardless of what comes out from this point forward. I dont know how you can undo this shite now.

What a mess. The players have no incentive to settle anything with the season almost over. Good luck Rog

That's a lot of supposition on PFT's part.

Nice. Anything bad that comes to RG on this is a positive for everyone.

Vilma and the players should press this til it ends. It means nothing to our season at this point, but it'll make me feel better seeing Roger have to own up to this all being bull shite.

might as well at this point but the question remains, lets say Vilma and his lawyers hit a home run and win this whole thing. the season is over now, the Saints are done. how can you possibly offer restitution for that...including us the fans? There is no argument that this shite didn't affect our team in a major way. It clearly did, I mean people are angry but there is a small chance we could even lose Payton after it is all said and done. WTF then, Goodell?!

They haven't even looked at RGs tortious interference yet. That's the knockout after other things have gone Benson's way.

Based on the things I am hearing from good friends who have represented major Federal cases against LA politicians this is the area that scares the NFL the most. It would be easier and less costly for them to drop everything now, but ego has the NFL in a fricking no win situation. RG goes down as the biggest dicksucker in history of the league. Period.

one thing stands out. if the league drops/reduces suspensions, it makes the case against Goodell stronger (he screwed up). This is incentive for the league (Tags) to hold fast on all initial suspensions. I wouldnt expect to see any reductions. And it looks like this will linger in to next season potenially scrwing it up a bit too... A potential win for goodell. We lose our coaches/GM this year, and lose our players next year. Theyve fricked us for 2 years.

Ahhh frick it. Who cares. Season is over and Payton will be back next year so it's moot now. We should be moving on from the Vilma/Smith era so IDGAF about them being suspended. We need to infuse young, talented playmakers on the front 7. Good luck to Vilma to clear his name, but if it stays the same, I won't shed a tear.

That's why I mentioned "no win" situation. However, after things start to look really bad for a client, a level-headed atty will step up and start discussing exit strategies.

This is partly true. Tags will come back with the same penalties as Goodell for that very reason, but Vilma and the others can't be suspended into next season, as the original suspension said "for the 2012 season" and not "an entire season". In order for Vilma to be penalized next year, Tags would have to rescind Goodell's punishment and make one of his own. But Tags won't do that because it would cripple Goodell's chances in defamation suit
