| SCOTUS to release fate of Prop 8 case tomorrow (Posted on 12/2/12 at 9:50 pm)
The Prop 8 case was discussed Friday. Tomorrow they are supposed to release their decision whether to a)take the case (with a ruling expected by June 2013) or b) deny cert to the case. If they deny cert, Prop 8 is dead and gay marriage is legal in California (as soon as the Ninth Circuit issues the mandate which will take a few days). It's been a little over four years since the State of California (voters) stomped out the freedom to marry for gays and lesbians in California. Hopefully the SCOTUS wants to be on the right side of history and kills this law tomorrow. It only takes four justices to vote to take the case, so who knows? Here's hoping tomorrow is a HUGE day for equality.

I fully support the freedom of two consenting adults to enter into a public contract and get married. I wish, and I really mean this, you were more supportive of other freedoms.

States rights are important until it comes to an issue he's passionate about, then it's "screw the States"....

he's not supportive because he doesn't even understand the concept. People like him just support the things they want, then use buzzwords like freedom, equality, diversity, fairness, etc to try to describe their cause.

It's one of the few areas I support federal law. Ideally, I wouldn't have the government involved in marriages, but as long as they are, I can't see how you can constitutionally prohibit same sex marriage.

They need to throw out the votes in all the states that voted yes this past election if they kill prop 8.

my absolute favorite is "social justice". you can be virtually guaranteed that anyone who uses this term in seriousness likely lives life with no basis in reality

You can, and people do, apply the word justice to anything. It's a bunch of 4 year old girls with some warped sense of fairness and how things should be.

I think I've said this before, but states rights without a document to protect individual liberties ain't worth a shite. Unfortunately the judicial branch has diluted the power and protection of that document. I don't get some who claim to be for liberty and then support state tyranny in lieu of federal tyranny; like it's somehow so much better.

That's not true. You're probably going to be severely let down if you are holding that out as fact. The judges already granted two cases from Friday's conference, and there will be a full order list released tomorrow. There's a chance the fate of those cases will be decided tomorrow, but considering there is another conference Friday and they have 10 related petitions to sift through, I'd bet they won't even mention those cases tomorrow.

I support states right, but there is no reason the fed or state governments should have any say so in marriage. We need to get rid of different tax rates and let private companies and churches decide who they want to marry. If someone wants to marry a rock, so be it...let some one open up a company that marries ppl to rocks.

A federal district court and a federal Court of Appeals determined that this violates the 14th Amendment. This is too big for it to be a states rights issue. Can you explain to me what a couple that is legally married in one state and then moves to another state where it's not legal is supposed to do ?

My Take: marriage itself should be left completely to the churches and independent of government. If churches want to marry 2 gays, let them. Any two people who want the benefits currently associated with marriage- including those who get married in the church-must apply for a government civil union for those benefits.

I honestly just do not understand why some politician on any side of the isle wont just nut up and say this. it's a compromise. and it takes the debate off the table so people like toddy will have to actually think about the other issues when deciding who to vote for.
