Wouldn't be the first time. The way I look at it is 1. The deer gets put out of misery and 2. The meat doesn't go to waste.

I think technically you are supposed to alert the authorities if you've hit a deer on the HWY. If you have tags, then yes you can take the deer. Hence the stories about cops asking for tags. If not, the cops will take them. Maybe donate to a soup kitchen or just have the hwy dept. come scrape it off the road if its demolished or ruined.

ETA: As to your scenario, a lot get left where they are to rot. And sometimes secondary motorist will get the deer if the driver doesn't want it. Or cut antlers off a buck. All of that is illegal technically. (Failure to report an accident, taking a deer without tags, wanton waste, etc.)

We were at a deer / car wreck scene one evening - deer was suffering - bud was going to slit deer's throat - officer asked if there was a tag for the deer

You know, i'm fine with this if HE is going to put it out of it's misery quickly. But that SOB better not let it suffer on a technicality. I'd rather take the ticket/fine/jail than watch that crap.

I actually knew an old hick up in Mississippi who would hunt with the front end of a Datsun 120.
