In a sense yes. If they cause an accident they are liable for injuries and damages sure but i don't think enjoying a few cold beers while on my boat should be illegal.

I can see the argument to separate water DWIs from land DWIs but truth be told you have a much greater chance of hurting and killing people in your boat, both your passengers and your others in heavily boated areas...

agree on a few cold beers yes.. but snot slinging drunk and killing or injuring others there needs to be a penalty and deterrent.

If you don't think this is possible then may I point out the incredible number of restrictions that seaplanes face? Many lakes and wilderness areas prohibit seaplanes due to the potential for noise (mostly it's truly incredible NIMBYism).

Very interesting as I have not thought about this in this way. Another question, has anyone been asked "how much have you had to drink" or gotten a DWI (without an accident) while on the water? I fish out of Shell Beach and every time I have been checked by WLDF I have never been asked although my beer has been in plain sight. I guess they could tell I wasn't sh*tfaced but still never asked. Disclaimer: I do not have more than 4 beers if I'm driving and none if kids are on the boat.

A guy that used to live down the street from me in Metry... While pulling into the slip at eddie pintos at bayou bienvenue... WLF was waiting for him....as soon as he got out of boat they started with..

have you been drinking and how much....... after hours in the hot sun and in a boat all day.. admittedlly drinking all day.. he miserably failed the field sobriety test....

he got arrested for dui and his BAC was below the legal limit but he still got two or three other fines he could not get out of..
