The mailman followed me all the way home from work yesterday. I passed him while he was delivering mail at my work and he was already at my house when I got home (he aged 15 years but I am sure it was the same guy). He walked aggressively up to me and reached into his bag. I shot and killed him before he could hit me with his fist.

Silly, right? I hope nobody ever follows you home after a restaurant because your wife left her purse there. Same fricking thing.

No. Kid was on his own property, having been chased by an unknown car for miles and now he is being approached by an unknown person in anger. If he is concerned for his safety, he can shoot. It may be justifiable, but I'm fairly positive you would be fighting that one in court. Cops should have been called, window should have been up.

The real question will come down to when she admits she pulled the gun. If she was holding it in case her husband was getting a beat down, that's a whole different situation than if she dug it out only when she saw him go down. As quick as that happened, I would guess she had it in her hand when they pulled up.

You wife leaves her purse at a restaurant. Somebody follows you home to return it to you. Do you shoot them? They have done nothing to harm you, at all. Nothing.

I know that you are just trolling to stretch this on...but seriously. If some dude is kind enough to pick up my wife's purse...and then is kind enough to follow me home for 20 miles....and then is just so unkind enough to approach me like a crazed monkey while cursing at me and calling me a mother fricker...like this guy did.....yeh, he would be a dead arse "purse returner" and I would have to face the consequences.

AGE ASIDE (because I dont know the laws on age)

If the guy woulda smoked his arse with the pistola when he approached the truck attempting to throw the punch....I cant see how he would have been liable at all? To me that would text book self defense (even though the dude didnt present a weapon during the initial attack)

There is no way to gauge if you are going to get your arse whooped or not?

I tend to agree with that...but not totally sure.

Now had the young guy shot the older guy through the door when the older guy started punching, then I'd think it would definitely be self defense.

So you would just let your wife get raped and your kids murdered by the escaped serial killer?!?!?!?

See how bringing stupid hypotheticals into a conversation don't help? We are talking about THIS situation.

Anyone else think that if they are going to charge the wife here that the second guy that comes out of truck shouldn't be charged with assault as well?

You can come to the defense of another.

so what if I drive a jeep and dont have windows at the time of the incident? (you guys have probably read that thread on here before)...would I have less rights to protect myself than someone with windows?

I know that we are all reaching and could come up with a ton of "twists" to change each others thoughts but to me....if I gotta take some dude down in the fashion that this played out in....and I end up getting convicted....then so be it.

If you dont believe in that...then you dont need to be carrying a gun anyway because it is a simple wast of time and money for you to do it if you are going to go through a whole trail process before you defend yourself.

Just opinion of course...

The dude was fricking dumb for following them home, calling them out, throwing the first punch, etc

No self defense here. Take your arse whippin that you asked for.

Thats a quote from you. In this quote, you are wrong. You cannot shoot all willy nilly, sorry.

You were being stupid by saying he should shoot. The kid didnt have a gun.

Yeah, I know. You were the one who said the kid could shoot. He didnt have a gun in the truck, you know that, right?

The main lesson: Don't swing on a truck full of guys that are younger and in better shape than you.

What should have happened was the kids called the cops, explained the situation and followed their instructions. That would have prevented everything else.

From the news story it is unclear whether the guys knew that they were followed home. It says they were followed but doesn't say that they knew they were followed. Entirely possible that they didn't realize there was a problem until they got out of the truck. Of course, they could have known the whole time. Not a big difference either way.

That nice person returning the purse would wave, smile, greet, and walk with a different stride.

This older actor was an out-of-control a-hole...aggressive in every aspect.
