Update:

Her mom asked the last doctor that saw her what broken bones she had. The doctor said collarbone, arm, ribs, ankle, femur, pelvis, and too many more to list. She has been awake and talking though.

So if I'm driving my boat and my dumbass friend jumps out and dies, it's my fault?

Curious because somebody has jumped out of my boat while I was running before.

Dude is fricked and should be fricked. If that was my daughter, I would hunt his arse down like a dog. No matter how drunk all people get, he should of stayed sober! Once he started seeing people getting drunk, he should of parked the boat for the day.

Yes, if your drunk driving & a sober guy runs a red light & you t-bone him. That is you arse. If he dies, even tho he was in the wrong & you are legally drunk, vehicular homocide.

Prayers for her recovery. As for him, I'm gonna refrain from saying anything cause I've done some really stupid shite. Fortunately, no one was ever injured.

This was in Arkansas, but I'm sure he had taken a course given his age, but I don't know the guy she was with. Anyone born after 1/1/86 is required to take a course and be licensed in Arkansas.

Most fatalities with boating involve operator controllable factors. Your responsibility revolves around that single word, controllable.

In this case not only was the operator drunk, and allowing unsafe practices on the boat, his boat movement while intoxicated led directly to the person falling and getting run over. He's screwed.

I highly doubt it, but it probably depends on the laws of the state you are in. I got a ticket when my buddy decided to stand up in the back of my jeep when I had the top off. I didn't even know he had stood up. The officer said I would have been responsible if he fell out.

Yeah, if someone just decides to jump from your boat on a whim, there's nothing you can do to stop that and it's not your responsibility.
